Terms of Service
Effective date: 2026 · Kota Kinabalu, Sabah, Malaysia
Please read these terms carefully before using CareFinder. By submitting a job request or creating a caregiver profile, you agree to these terms.
CareFinder is a caregiver matching platform. We connect families who need care with caregivers who provide care. We are not an employment agency, a staffing company, or an employer.
When a family and caregiver enter into a working arrangement through this platform:
- The employer is the family — not CareFinder
- The caregiver is hired by the family — not by CareFinder
- CareFinder is not a party to the employment arrangement
- CareFinder has no control over the day-to-day working relationship
- CareFinder does not set wages, hours, or working conditions
CareFinder is not responsible for collecting, processing, enforcing, or recovering payments between users.
All responsibilities associated with employing a caregiver — including payment, EPF, SOCSO, leave entitlements, and employment law compliance — rest with the family as the direct employer.
CareFinder does not provide medical services, nursing services, healthcare services, or clinical supervision. Any information presented on the platform is intended to assist with matching and should not be interpreted as medical advice, professional healthcare advice, or a certification of a caregiver's competence. Families remain responsible for determining whether a caregiver is suitable for their specific care requirements.
We take matching seriously and work hard to present accurate, verified profiles. However:
- We do not guarantee the quality, reliability, or conduct of any caregiver
- We do not guarantee that a caregiver's declared skills accurately reflect their ability
- We do not guarantee that a job posting accurately reflects the actual workload
- We are not liable for any loss, injury, damage, or dispute arising from a working arrangement made through this platform
Verification on CareFinder refers to the documentation and confirmation process used by the platform. It does not constitute a guarantee of competency, professional qualification, fitness for a particular role, or future performance.
We urge all families to conduct their own interviews and due diligence before engaging any caregiver. A trial period is strongly recommended for all new arrangements.
CareFinder does not verify, screen, or guarantee the work permit status, immigration status, citizenship, visa status, right to work, or legal eligibility to work of any caregiver listed on the platform.
Unless explicitly stated otherwise, CareFinder does not conduct criminal background checks, medical screenings, reference checks, or independent verification of professional qualifications.
By using this platform, both employers and caregivers acknowledge and agree that:
- They are solely responsible for ensuring any working arrangement complies with Malaysian employment and immigration law
- CareFinder bears no responsibility for any legal consequences arising from a working arrangement involving a caregiver without valid work authorisation
- If in doubt, they will seek independent legal advice before entering into any arrangement
By creating a profile on CareFinder, caregivers agree to:
- Provide accurate and honest information about their skills and experience
- Update their profile if their availability or skills change
- Respond to soft pings honestly and promptly
- Not use the platform to facilitate arrangements outside of agreed terms
- Not create multiple profiles or attempt to game the review system
- Conduct themselves professionally and with dignity toward patients and families
By posting a job on CareFinder, employers agree to:
- Provide accurate information about the patient's condition and care needs
- Not misrepresent the job scope to attract caregivers at a lower rate
- Provide a proper mattress for live-in and night shift caregivers as a minimum standard
- Provide a foldable reclining chair for on-site arrangements as a minimum standard
- Pay the caregiver the agreed rate on time
- Treat caregivers with respect and dignity
- Provide honest and accurate reviews after a job
CareFinder reserves the right to remove any caregiver or employer from the platform for:
- Repeated misrepresentation of skills or job scope
- Fraudulent reviews or gaming of the reputation system
- Payment avoidance or financial misconduct
- Behaviour that endangers patient safety
- Any conduct that violates these terms
CareFinder acts on patterns — not individual complaints. Removal decisions are at our sole discretion.
To the fullest extent permitted by Malaysian law, CareFinder and its operators shall not be liable for any direct, indirect, incidental, or consequential loss or damage arising from:
- Use of or inability to use the platform
- Any working arrangement made through the platform
- Any act or omission of a caregiver or employer
- Any inaccuracy in a caregiver profile or job listing
We may update these terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of the platform after changes means you accept the updated terms.
These terms are governed by the laws of Malaysia. Any disputes arising from use of this platform shall be subject to the jurisdiction of the courts of Malaysia.
